Man injured in semi-truck accident wins $18.5M verdict

Semi-truck accident: A 46-year old man severely injured in a crash with a semi-truck on I-74 in Hendricks County in 2013 was awarded $18.5 million by a jury last week.

Timothy Robbins, of Franklin, sustained significant brain injuries as a result of the collision with a Werner Enterprises Inc. semi-truck driven by Terri Hampton. He will require lifelong medical care.

His father, Shelly Robbins, brought the lawsuit against Werner and Hampton more than four years ago, which resulted in a seven-day trial and jury verdict for compensatory damages in Robbins’ favor. The jury found Hampton to be 100 percent liable.

Shelly Robbins was represented by Tony Patterson and Pete Obremskey from Parr Richey Patterson Kruse and Scott Montross and John Muller from Montross Miller Muller Mendelson & Kennedy.

“There’s no question he was hurt and terribly injured,” Patterson said Wednesday in an interview referring to Timothy Robbins. “The real dispute in the case dealt with who was at fault.”

Patterson said he and Robbins’ other attorneys are pleased with the result. He also said this is the highest jury verdict he’s ever had when representing an individual. Patterson also said he’s unaware of a larger verdict coming out of Hendricks County.

Werner Enterprises and Hampton were represented by Keith Gaston, Bruce Jones and Bradley Michael Owen from Cruser Mitchell Novitz Sanchez Gaston & Zimet LLP. They did not immediately respond to a request for comment on the verdict and whether the company plans to appeal.
