During the inspection and while climbing down a fixed ladder, his foot slipped off a rung causing him to fall. As a result, he sustained a shattered tibial plateau, multiple knee ligament tears, and a torn rotator cuff of his right shoulder. The plaintiff alleged that the ladder had never been updated and did not conform to applicable safety codes, which was a substantial contributing factor to the fall.
The settlement included $2.2 million and an agreement to pay any future medical bills related to injuries suffered in the fall.
