Failure to Diagnosis a Medical Condition

A failure to diagnose a medical condition is often the basis for a medical malpractice lawsuit.  Whether it be a missed diagnosis of cancer, a fracture, a stroke, a heart attack, or a missed diagnosis in an emergency room, victims of malpractice are subject to a physician’s failure to appreciate medical symptoms.  Recently, we met a client whose husband presented at a local emergency room with shortness of breath, chest pain, and cold sweats.  Rather than admit him, the hospital simply told him to follow up with a family physician.  Unfortunately, he was not appropriately diagnosed and was sent home in the middle of a cardiac crisis.

A misdiagnosis does not always occur in an emergency room, however.  Often we meet people who had been complaining to their family doctor about something for a long time and, due to the failure of the doctor to follow-up and order testing to find out why the complaints were occurring, an underlying cancer or serious illness was not timely treated.
